Darfur: Waya Demands N476.4 M from Nigerian Army
For allegedly not paying the sum of N476,448,000 million for the supply of military kits and equipment to the country’s troops serving as part of the United Nations Force in Darfur, Sudan ,Kaduna-based businessman, Mr. Joseph Waya has called on President Umaru Yar’Adua to order the Nigerian Army to pay his company, Esquire Ventures Limited .
He said the Army authorities should also be made to refund of the sum of 358,000 Pounds Sterling allegedly lost as deposit to the United Kingdom-based manufacturers of the supplied kits due to the inability of the force to fulfill its contractual obligation to his company.
Waya,in a statement issued in Kaduna on Thursday, said that his company had come under intense pressure to pay up the loans it secured from some banks for the supply of the equipment to the Nigerian troops in Sudan or risk punitive measures, due to the current development in Nigerian banks.
According to him, “it had become imperative for President Yar’Adua to intervene in the matter at this juncture as the Army authorities has not only refused to settle its indebtedness to the company, but has also declined to submit itself to arbitration as provided for under the terms of agreement signed by the two parties when the contract was being entered into.”
“In January 2008, four of our companies were awarded contracts by the Nigerian Army to supply various specialist military items valued at N1.2billion. All of these items were for use by Nigeria ’s UN-backed troops deployed to Darfur , Sudan .
“By the terms of the contracts we were to be paid 15% mobilization fee. At the time of signing the contract the Army authorities said the supplies for the UN troops were urgently needed and, therefore, pleaded with us that since they were yet to receive funding for the project from the Government, we should source money to execute the contracts and await payment.
“As patriotic corporate citizens, we obliged this request and secured some loans from our bankers and took credit lines from our UK partners, to supply the items. Between January to August 2008, we supplied items to the Army valued at over N660million. Of this amount, only about N175million was paid in August 2008, while arrangements were on to pay our balance of over N476million before the late General Yusuf was removed as chief of Army staff in August 2008.
“To confirm the veracity of all contracts awarded by his predecessor, Lt. Gen. Dambazzau set up two independent committees to probe all contracts. One of the committees headed by Major General Azurunwa which sat between 23rd February and 6th March, 2009 invited us for the verification exercise after which it certified all our contracts as duly executed and good for immediate payment.
“In the light of this seeming indifference by the Army authorities and given the continued threat by the banks to auction our mortgaged collaterals, we reluctantly instructed our lawyers over three months ago to write and demand our payment from the Army. On the heels of this letter, two senior officers from the Army headquarters called us to a meeting claiming to have been instructed by the chief of Army staff to negotiate and secure discount on our outstanding debts to enable the Army clear the debts in two installments. The meetings were not conclusive because we told the officers that it was almost impossible for us to give discount on a contract already executed and for which we have accrued huge bank interest as a result of delayed payment by the Army. Since then, all efforts to reach either the chief of Army staff or any of his principal staff officers over the matter were subsequently frustrated.
“In humbly pleading for your intervention, we need to inform your Excellency that, in the last one year we have been paying a default interest of 30% to our banks on the loan used to supply the items for our UN troops. Now with the punitive measures by the CBN on banks to recover loans, we have come under intense pressure to pay up our loans or face more punitive consequences.
“We rendered patriotic service at a time it was most needed by our troops and we do not expect to be treated with such ignominy nor intimidated into silence as though we did a disservice to our fatherland for taking the risk to obtain loans to kit our troops in Darfur .
“The Nigerian Army as a pivotal pillar on which our democracy rests must not be seen acting in a manner reminiscent of military autocracy, where might was right. This is clearly the anti-thesis of what democracy upholds. “We hereby plead with your Excellency to please, use your good offices to get the Nigerian Army to pay us the sum of N476,448,000 it owes us and refund of 358,000 Pounds Sterling in lost deposit to the manufacturers, to enable us offset our indebtedness to the banks,” he added.
